1. Who We Are

ClickSorcery is a desktop software product developed and distributed by Wicmath OÜ, registered in Estonia (registry code: 12189863).

By downloading, installing, or using ClickSorcery, you agree to these Terms of Service in full. If you do not agree, do not download or use the software.

2. What You Are Buying

ClickSorcery Desktop Pro (€79 one-time) is a perpetual software license — not a subscription, not a SaaS service, and not a managed AI service.

When you purchase Desktop Pro, you receive a perpetual license to use ClickSorcery on up to two personal devices, all updates released during the current major version, and access to all desktop features available at the time of purchase.

You are not purchasing AI processing capacity (you bring your own API keys), cloud storage or data hosting, a guarantee that any third-party AI model or API will remain available, or technical support beyond community channels.

The software is provided as-is. We make no promises about uptime, availability, or fitness for any particular purpose.

3. Your API Keys and Third-Party Services

ClickSorcery connects to third-party AI and automation services using your own API keys. This means:

• You are the customer of OpenAI, Anthropic, ElevenLabs, Stripe, n8n, and any other service you configure — we are not
• You pay all third-party costs — API usage fees, token consumption, Telegram bot costs, voice call minutes, and any other charges from services you connect
• We have no access to your API keys — they are stored encrypted on your own device
• We are not responsible for charges incurred on your third-party accounts as a result of using ClickSorcery

ClickSorcery uses OpenClaw — an open-source AI agent runtime on your computer. OpenClaw makes API calls using your keys. You are responsible for usage limits, cost controls, and any charges incurred.

4. Local Data and Memory

ClickSorcery is local-first. Agent memory, documents, project files, and business data you provide are stored on your device (including the Obsidian Vault). We do not transmit vault contents to our servers.

You are responsible for backing up your data, securing your device, any third-party personal data you store in the vault (you are the data controller under GDPR), and secure transfer when moving to another device.

5. Autonomous Agent Actions — Your Responsibility

ClickSorcery includes AI agents that can take automated actions on your behalf, including sending emails and messages, triggering n8n workflows, posting to social media, making API calls to financial services, sending Telegram messages, initiating voice calls, and modifying files or databases.

You are solely responsible for all actions taken by agents you configure and activate. We are not liable for data sent, messages made, transactions initiated, data loss, or any business, legal, or personal consequence of agent actions.

ClickSorcery includes Human-in-the-Loop (HITL) and Security & Guardrails settings. It is your responsibility to configure these appropriately. Default settings do not prevent all autonomous actions.

By default, autonomous agents have no access to payment processors, financial accounts, outbound email (SMTP send), or any system outside the user's designated workspace folder. These permissions must be explicitly granted by the user in Vault settings. Wicmath OÜ accepts no liability for costs, messages sent, data modified, or any other consequences resulting from permissions explicitly granted by the user to autonomous agents.

6. Data and Privacy

We collect only your email address (license activation), license key and activation status, and a machine ID hash (no identifiable hardware data stored on our servers).

We do not collect your API keys, conversations, documents, or business data. Full details: Privacy Policy at /privacy.

7. Trial Period

ClickSorcery offers a 7-day free trial with full access. No credit card required. At the end of the trial, premium features are restricted until a license is purchased. Your data and configuration remain intact.

8. Purchases and Refunds

Use the 7-day free trial (Section 7) to evaluate ClickSorcery before you buy. The trial gives you full access without a credit card so you can decide whether the product fits your needs.

All license purchases are final. We do not offer refunds, money-back guarantees, or partial credits after purchase.

Nothing in this section limits your statutory rights as a consumer where applicable law requires otherwise.

9. Acceptable Use

You may not use ClickSorcery to:

• Violate any law or third-party terms of service
• Send unsolicited bulk messages or scrape data in violation of third-party terms
• Automate actions on accounts you do not own
• Build systems to deceive or harm others, or circumvent API rate limits
• Reverse-engineer, decompile, resell, or sublicense the software except as permitted by law

Violation may result in license revocation without refund.

10. Intellectual Property

ClickSorcery software, its design, and associated materials are owned by Wicmath OÜ and protected by copyright. Your license grants you the right to use the software — not to copy, modify, decompile, reverse-engineer, resell, or sublicense it.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ClickSorcery and Wicmath OÜ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, API costs incurred, damage from agent actions, downtime, or actions of third-party AI models.

Our total liability in any case shall not exceed the amount you paid for your ClickSorcery license.

The software is provided "as is" and "as available" without warranty of any kind.

12. Modifications to Terms

We may update these terms from time to time. For material changes, we will notify you through the application or by email. Continued use after changes take effect constitutes acceptance.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Estonia and applicable EU regulations. Disputes shall be resolved in Estonian courts, unless EU consumer protection law grants you the right to bring a claim in your country of residence.
